COVID-19 Cooking Class Policy & Customer Liability Waiver

FARADAY’S COVID-19 PRECAUTIONS, CANCELLATION POLICY & WAIVER OF LIABILITY

By signing up for a Cooking Class at Faraday’s, you agree to follow and comply with the below Requirements & Policies – PLEASE READ:

When you arrive for class, please stop at the register for a staff member to check you in. When checking in we require that all instructors, assistants and class participants confirm that neither they nor anyone in their household are exhibiting any symptoms of COVID-19,  other than those that they would normally have due to annual allergies or pre-existing health conditions such as COPD. These COVID-19 symptoms include: fever, shortness of breath, loss of sense of taste or smell, dry cough, runny nose or sore throat. 

For the safety of all class participants, our employees, instructors and their assistants, you and all parties booked for this reservation will be required to wear an approved mask or shield at all times during class and when shopping in the store, except when eating. There are no exceptions, and we cannot refund your money if you do not adhere to this safety policy and are asked to leave. Thank you for your understanding and commitment to the safety of yourself and others. 

We will be sanitizing/ washing/ disinfecting all tools, workstations, seating areas and equipment before class and throughout class, as appropriate.

The kitchen area will be blocked off until 10 minutes before class begins. A touchless temperature check will be taken before each party is seated.  Our seating will be rearranged to allow for social distancing, and seats will be assigned. Some attendees will be seated at the counter, and others will be seated at tables that will still have a clear view of the chef. 

City of Austin Health Code regulations require that no food be taken home after class. 

Understand the risks: Although we are doing everything in our power to keep you safe (frequent hand washing, cleaning all the surfaces before each class, requiring face coverings), any social activity is a risk given the current situation. If you are in a high-risk group, we strongly suggest you hold off on cooking classes until there is a vaccine available.

Faraday’s Class Cancellation Policy

We understand that life happens and emergencies do occur.  However, we also hope you understand our commitment to all of our students and the preparation that goes into creating a successful class.  For this reason, we ask that if you are unable to attend a class, you must notify us 72 hours in advance of the scheduled class time to receive a refund or credit towards another class.  Within 72 hours of a class, all cancellations are non-refundable (even if someone else gave this class to you as a gift).  If you cannot attend a scheduled class, we encourage you to send someone in your place.  In this case, please call ahead and notify us of the participant change.

Additional information for Hands-on Classes: 

Please bring an apron from home if you wish to wear one.  We will not have them available to borrow. 

Use effective hand-washing and sanitizing procedures: Hands must be washed for 20 seconds before any food is handled. Food safety gloves will be provided and must be worn when handling any food.

If you register as a single attendee, you will be grouped with no more than one other person.  If you registered for multiple seats, you will be grouped with the people you signed up with, up to a max of 4 people in a group. Groups larger than four will be split up. 

Face masks must be worn at all times when cooking and may only be removed when you have been seated to eat at the end of the class.  Respect social distancing between groups, please.  

Wear closed toe shoes for safety. 

If your hair is shoulder length or longer, it must be pulled back (hair must be secured firmly so no touching is needed).

Waiver of Liability Relating to Coronavirus/COVID-19 

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Faraday’s will require you to wear an approved mask or face shield during class (except when eating). However, Faraday’s cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing Faraday’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Faraday’s services and/or enter onto Faraday’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.  ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize Faraday’s services and enter Faraday’s premises. These services are of such value to me [and/or to my children,] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize Faraday’s services and premises in person. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Faraday’s and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Faraday’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. I understand and agree that the law of the State of Texas will apply to this contract. I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.  I UNDERSTAND THAT WHEN THIS RESERVATION WAS PURCHASED, THE PURCHASER AGREED ON BEHALF OF ALL PARTIES ON THE RESERVATION THAT EACH PARTY WOULD BE REQUIRED TO SIGN THIS WAIVER IN PERSON AT THE TIME OF THE CLASS.
